Don't get me wrong. I want that bastard in jail but I don't know how they can subpoena him when they are accusing him of causing the insurrection. Same with the others. But I'm not a lawyer. I hope someone can explain.

I don't see him able to give a straight answer to mere congress members, or a straight answer of any kind at all.
I strongly suspect that if he were in front of a federal judge, or in grand jury chambers he'd not answer straight. Its not what he does and he cannot accept that anyone else has power over him.
Given his delusional state its possible he's incapable of standing trial due to impaired capacity. I expect a lawyer or 2 will be making such a case. TLG will do anything to avoid being classed with other mortals.
