Lt. Col. Stuart Scheller Jr. is currently in pre-trial confinement in the Regional Brig for Marine Corps Installations East aboard Marine Corps Base Camp Lejeune pending an Article 32 preliminary hearing, said Capt. Sam Stephenson, a spokesman for Training and Education Command. The time, date, and location of the proceedings have not been determined. Lt. Col. Scheller will be afforded all due process.
Scheller first gained notoriety on Aug. 26, when he posted a video on Facebook and Linkedin criticizing the handling of the U.S. withdrawal from Afghanistan. In the video, Scheller accused senior military leaders of shirking their responsibilities, and questioned some of the command decisions that were made leading up to, and during, the final moments of Americas longest war.
People are upset because their senior leaders let them down, and none of them are raising their hands and accepting accountability or saying, We messed this up, Scheller said in the video.
Stu Scheller Sr. described his son as a proud American who loves the Marine Corps and has served proudly for the past 17 years.

I know nothing about the military so I ask.

(7,654 posts)I'd guess failure to follow orders is in there. Disrespect to a senior officer possibly. Maybe Conduct Unbecoming.
All told probably not enough to get him jail time but definitely enough for a dismissal which is equivalent to a dishonorable discharge if it's at a general court-martial, although I believe they can try officers at a lower level now..

(53,193 posts)Thats Article 133. Article 92, Failure to Obey an Order or Regulation, will probably also be added. They might also try an Article 117, Provoking Speech or Gestures.
Theres also Article 134, the General Article, but some commanders wont use it. My first battalion commander, LTC Jack McGuinness, told his company commanders that if they couldnt come up with a non-Article 134 charge they werent to use Article 15 (the nonjudicial punishment article) to correct the problem.

(8,887 posts)Uhm, yeah the law (including UCMJ) has specific rules about gag orders and they know exactly how to handle that if you violate them

(13,013 posts)Maximum punishment: Dishonorable discharge (dismissal for an officer), forfeiture of all pay and allowances, and confinement for 2 years.
However, I am skeptical that he is in pretrial confinement which is generally appropriate only in cases in which the accused is a flight risk. I suppose that if the LTC has made it clear he will continue to commit crimes if not confined, pretrial confinement would be appropriate.

You only do it if they are a flight risk, a threat to themselves or others, or basically can't keep from committing more crimes.
There would have to be a hearing within 7 days to determine if he stays in confinement or not before trial. I would guess that if he's ordered to stay away from any statements about the case or social media postings, they will release him. If he refuses, then back in he'd go.

Ten to one this is the first time any of the MPs on post have ever seen a lieutenant colonel in jail.

(7,654 posts)a hearing will be held to see if they've exhausted all means beyond confinement to keep him from committing future crimes.
If he doesn't get released, that will tell you he's being obstinate...if he goes back in, that will tell you he violated whatever orders he was given.

Doesn't matter if he is a Democrat, or a Retrumplican. There are avenues available to file grievances, or question leadership in the military. Social media isn't one of them.
It is way past time for the military to start dropping the hammer on this shit.
As a member of the military, the guy is free to vote for, support, or donate to whatever political party that he wants to, but, he is NOT free to put on his uniform, or use his status as a member of the military, to go in public and smear military leadership.
We simply cannot have his kind of behavior in the military.

(113,957 posts)that they think they retain every right that a civilian does and social media only makes it worse. This guy had been around far long enough to know better, but those comments from the public underscore how little the civilian population understands the differences.
Several mental health professionals who work with the military, PTSD, and other related conditions believe he's ill. I'm sure he will receive an examination, at least. If he's brainwashed by "the cult," even though he does not appear to be aligning with the Trump ilk, well, he will face the consequences.

Somehow I doubt this needless self destruction by a mature man is unrelated to the mass self destruction we're seeing all over -- most of it on the right, but also some personality types across the spectrum who are less tethered to reality than average.

no matter who was in charge. I'd say that trump's sellout to the Taliban was a definite
factor in the chaos. In the end, the collapse of the Afghan army and the chaos of the
withdrawal only prove that the US needed to get out. Another stupid war, nothing
accomplished but death and destruction.
I'll bet the Lt. Col. and his parents are trumpers.
