Judge Tanya Chutkan, a former public defender, sentenced Matthew Mazzocco to 45 days of incarceration. The government sought home detention.

A federal judge said Monday that there “have to be consequences” for the Trump supporters who stormed the Capitol on Jan. 6 and raised concerns that members of the mob were getting off light.

Judge Tanya Chutkan, a former public defender, made her comments while sentencing Jan. 6 defendant Matthew Mazzocco to 45 days of incarceration. Federal prosecutors had requested that Mazzocco be sentenced to three months’ home confinement, which Chutkan said wouldn’t provide adequate deterrence.

“There have to be consequences for participating in an attempted violent overthrow of the government beyond sitting at home,” Chutkan said Monday.

“The country is watching to see what the consequences are for something that has not ever happened in the history of this country before,” Chutkan said. While Mazzocco was far less culpable of many others who participated in the riot, he was proud of what he did, Chutkan said.

“That mob was trying to overthrow the government,” Chutkan said, and “showed their contempt for the rule of law.” She rejected comparisons between the protests of the summer of 2020 in support of civil rights and the attack on the Capitol, which she said was “no mere protest.”

She got 2 months probation and a $3500 fine for being involved on 1/6. Her own lawyers expected her to get 6 months.

I have absolutely no clue what's going on at the DoJ, but it's not justice.

so, really, why are they getting off so easy?

I wonder if they are getting virtually no consequences so it looks like something when they give the "big fish" light sentences too.

and without any choosing to go to trial. Because, well, juries could be politicized without anyone knowing it in this day and age.

45 days should be the min for all of them.

MOST will walk with that "slap on the wrist" and small fines. I reject the comparison of entitled Americans at risk vs civil rights and equality for at-risk minorities and POC.

with more time for those who committed additional crimes.

And any and all of those in Congress, the Executive involved, and those who aided them, as well as the domestic terrorists groups, should be given the most time.

Stop pretending this was a protest that got out of hand.

This was insurrection.

public defender to think that. As a criminal defense attorney I agree, 45 days is a joke. Storming the Capitol while in session, violently or not, you go to jail or prison. People died, a person shot. Lucky they aren’t charged with felony murder. What would the consequences and noise sound like if Dems stormed the Capitol or attempted a coup.

Are these insurrectionists getting off lightly because they’re white? The sentences so far are a deterrent to no one.
