and he jerked the committee around for weeks so is there no penalty for that ??

So once he is arrested, couldn't he just be held until the house is good and ready to hold a hearing? Say after one of their long holiday recesses?

(26,735 posts)They didnt vote to use inherent contempt. They voted to refer him for a possible criminal prosecution.
Actually - they voted to ask the House to consider such a referral.
And you dont get locked up on a referral. You get locked up when you actually get charged. And perhaps not even then since its a misdemeanor. He might need to be convicted first.
And all of that ignores possible court action regarding the claim of privilege. Which could take a very long time

(26,735 posts)Inherent contempt (which hasnt been used since the other two options were added in law - and might never be) would theoretically allow them to lock him up now. But only until Congress is out of session. And the privilege claim really complicates that.
No chance of criminal charges because Congress isnt a criminal prosecutor.

Surely he will be thrown in jail for all this delay until time for testimony.

But the game is delay. He isnt going to fold just because the committee held a we really mean it vote.
My guess is that it will be after a grand jury indictment and at least one court ruling.
