19. The full House has to vote for contempt

There is a theory that would allow a committee action to be enough for Pelosi to send the referral, but it has never been done that way and it's unlikely that the courts would allow it.

Plus... the committee voted to recommend it to the full House for consideration. So that isn't an option at this point.

But for some reason, referring Bannon to the Justice Department for contempt must be approved by the entire House. Looks like it will be a party-line vote, surprise, surprise!

If you're going to hold someone in contempt of Congress... Congress needs to vote.

This has some recent support. A lawsuit involving Trump and House Democrats died because even a bunch of representatives can't represent the House itself without a House vote telling them so... and a bunch of Democrats (absent that vote) lacked standing to sue.

The things that democracy requires for it to survive and thrive is also the very thing that kills it.

Which does not bode well for the survival of democracy in the long run.
