(CNN)A New Jersey gym owner and former MMA fighter who punched a police officer during the January 6 riot was sentenced to 41 months in prison on Wednesday, becoming the first rioter sentenced for violence against the police during the attack.
Scott Fairlamb pleaded guilty to assaulting a police officer and obstructing an official proceeding in August.
"I truly regret my actions that day. I have nothing but remorse," Fairlamb said in court Wednesday, later adding to the judge: "I just hope you show some mercy on me sir."
His sentence will likely set an early benchmark for how harshly rioters charged with violence may be punished and ushers in a new phase of the Capitol riot cases, which so far have only had non-violent defendants sentenced largely to no jail time.

(47,625 posts)and there is also 36 months of supervised release following his time in prison. It probably would have been much worse had he gone to trial. The judge did say that he was fortunate that the officer wasn't injured. Hopefully, 41 months is enough for him to really turn his life around. I'm sure he won't have access to online Qanon conspiracies in prison.

(999 posts)41 months is 3 5 years in a federal prison. You lose the right to vote. You lose most of your rights and hopefully you aren't assaulted while in prison. Unless you have done some time in prison I don't think you have any idea of what he is about to go through.

(58,785 posts)At least, I've heard, federal prisons tend to be generally nicer and better run, and safer, than state prisons, such as here in GA, or wherever they store people there isn't room in overcrowded prisons for, like jails. If he was mine I'd have been trying for some comfort in knowing if "worse" came to "worse" he'd spend his time in a federal facility, and of course that what I'd heard was true.

He might hold his own in the first encounter until they get him sized up.
The subsequent altercations will be far more deadly.

(3,406 posts)That should help him think about his stupidity. I don't believe in his remorse, it is just to make the judge believe he is sorry about what he did.
41 months is only 3.5 years, and he may be able to get out earlier for good conduct or whatever...These people need to be punished hard to make sure they, or anyone else thinking about it, do not do it again.

A problem with sending people away for decades or life for treason is that thousands came believing they were patriots either demonstrating or prepared to fight to take their government back from a LW coup d'etat. Of course they shouldn't have believed it, and that doesn't make them innocent of crimes committed, but it certainly goes to punishment.
This has to be taken into consideration. Look at all the lies believed by some on the left and the eager support of election subversion that lead to. People being lead shamefully but seemingly sincerely wrong by manipulation of their weaknesses is common.
Now, all who engaged in systematic deception of the electorate and encouraged subversion, including media everywhere from Fox stars to slimey tweeters and bloggers -- I'd put them away for long, hard time.
Hopefully these dangerous times will have calmed down by the time this one's out.

So this kind of thing should make smart people grateful for the various strong layers of legal and ethical protections between those brought to justice and angry mobs. While they last.

(7,286 posts)I can't remember, but I don't think the Shaman attacked anyone. However he did do a lot of damage and there was that spear.
Just trying to figure out the distinctions and differences in crimes this guy was charged with and the charges the shaman faced in court.
Shaman gets 4 years, not sure which prison facility or what the specific charges ended up being.
there used to be this ongoing data base tracking arrests and convictions etc. Used to be posted here daily but haven't seen it in quite a while.

(146,336 posts)However, it's not an atypical low-time sentence. We're not going to imprison people for 20 years or life for hitting a cop.
I'm heartened to see that, as more serious offenses from January 6 are resulting in substantial sentences.
