the case will be dismissed with prejudice and the defendant can't be retried, per Oregon v. Kennedy.

I keep seeing and hearing this doomsaying just like before Chauvin's verdict. The Judge can admonish the prosecutors and defense they do it often most people just don't watch court. Judges are on a power trip this guy is on a BIG one. And has been for a couple decades. There has been NO misconduct that would be enough to dismiss this case by the legal standard and the judge knows it, he can bluster all he wants. The JURY decide Kyles fate and per the laws of Wisconsin idf they are properly instructed they should be be able to easily find him guilty. This reminds me of the wigs on fire over the victims thing. Which is actually common. How can you plead self defense while they keep calling the person my victim, it's prejudicial language and can have undue influence on the jury? Just like the prosecutors can't call Kyle the murderer. We all know he is we just can't say it.

Video clearly shows what happened and it doesn't equal murder. I think he was pressured to prosecute and is now tanking it to save face.
