So let us get this straight: This wackadoodle judge now wants the prosecution to produced an Apple Software Engineer before the end of the day to testify that by using your fingers to make a photo bigger you aren't actually changing the content of the photo.

Juries typically look to judges as their sherpa guide, so they're going to give extra credence to whatever he says.

(13,013 posts)It is clear the judge would deny the motion and there is no opportunity for the prosecution to appeal. My rule for a motion to recuse is "If you would strike the king, you must kill him." A pissed off judge - especially a stupid or biased one - can do a lot of damage.

It would however have a significant impact on the mindset of the jury

I have a real problem with laws that allow people to purposely put themselves in danger then scream self defense after killing people.

I then turn and run away.
You follow after me and present Potential for serious harm, I can at that point regain my right to self defense.
It's more complicated than that but that's the baseline.
You only regain it once you abandon the initial assault and retreat generally speaking.

Would that be erased if he was looking to shoot someone? I looks like that's what the DA was getting at with the talk about going to the 63rd street location ... that KR was looking for someone to shoot, why leave his location to a new one if that wasn't true

But actions show intent too so if he truly abandoned his earlier intent and ran away, and was then reconfronted he could have a viable claim.
Not saying he does, saying he could.

Is there some compelling reason why Rittenhouse's BFF judge needs this info immediately?

The judge's phone playing the tRump rally song and the prosecutor not even saying boo pretty much told me this thing is fixed from all angles.

(3,891 posts)The judge never really admonished the guy, or informed him of how telling racial jokes shows bias. Instead, the judge seemed to indicate that "others" would think there was bias. The judge was like- oops gonna have to let you go, if I don't people are going to think there is bias.

The judge probably knows it too, but he's an older guy like me and might not use a phone like that. But, the one that really knows is Rittenhouse. You can see it in his eyes that he knows damn well how a touch screen phone works.
