Obviously, it would be filibustered, so it'll need 60 votes. Since we only have two likely Republicans who will vote for it, we'll either have to eliminate the filibuster for this or pick up seats in 2022. In the House we can't lose more than 5 votes or so. Because of this, there will have to be some compromise, whether we like it or not.
Do you agree with some compromise, or should be go all out and simply say "No state shall ban abortion at all." I think the compromise should be what Roe is now, which basically lets states ban it in the 6th month or greater. But some might not agree...
Also, is there any chance at all that it in itself could be struck down by courts? On what ground would they have?

(14,959 posts)should expect that any law Congress passed affirming abortion rights wouldn't just be struck down for any reason/without any reason/whatever. They are totally unconstrained by legal scholarship or even the plain text of the Constitution. They say up is down, because we said so, and mean it.
They are so warped that some of them would even try to take the opportunity to declare that abortion itself is inherently unconstitutional and henceforth banned across the entire country, effective immediately.

(9,998 posts)This is fantasy talk. There is ZERO chance of any law getting through Congress. Plus Manchin is going to join the repubs, so you'll need a total of 9 repubs to get onboard.
They WANT Roe overturned, and aren't interested in a compromise that retains ANY aspect of it.

(15,385 posts)I said there are only two ways to pass it. Either to pick up enough seats in 2022 or somehow nix the filibuster. The "compromise" will be once one of those two things are accomplished.
BTW, after reading up for the past hour, it looks like Senator's Casey and Manchin might be opposed to this. Ugh, it just got even tougher to pass.
