That wouldn't get past other forms of privilege...

(12,995 posts)It is now clear that they are going to run the clock and that the courts will facilitate that.
AZSkiffyGeek
(11,004 posts)When did that become clear? Or do you just want to deny them their Constitutional rights since you don't agree with them?

(12,995 posts)Earliest trial date is July. Congress cant enforce their subpoenas if the courts are going to let those people ignoring subpoenas to delay until the next session. Its a total bullshit situation.

(2,271 posts)Once the matter falls within the purview of DOJ versus the 1/6 Committee, the clock for prosecution/trial is not at all affected by any change in Congress in 2022. Biden
/Garland will be in charge of DOJ at least until 1/25.
Dont want to interfere with the Garland and Biden bashing.

(17,911 posts)AFTER the 2022 midterms, perhaps even early 2023, he will be compelled to testify before a House committee that Republicans ensure doesn't exist once they take power. Wonderful! We're all saved!!
Thats not what I was referring to. I was saying that prosecutions are not within the purview of Congress, and that it is the DOJ that seeks indictments and prosecutes people in Court, and obviously, the time for the DOJ to do its work will not run out at least until Jan. 2025.
paleotn
(17,911 posts)for refusing to testify before a House committee that no longer exists? It's all moot by that point.
As far as the law, once the contempt indictment is filed, it does not not matter whether the Committee exists or not. Contempt of Congress carries a maximum sentence of 6 months for each count, not very much, but depending on the number of counts, not insignificant either.

(7,275 posts)Look at Steve Bannon. He's got his contempt hearing delayed until the spring.. Probably counting on getting a few continuances and by then they are counting on winning the house. Those contempt charges will be dropped by Keven McCarthy or whoever ends up being their speaker.
Why on earth should anyone of Trumps foot soldiers bother to care? Even if they don't get their hearings delayed, he's still better off ignoring the subpoenas. The consequences are not that dear, and by the time elections happen the charges will be dropped.

(7,275 posts)everything is opposite of what it should be, every day is opposite day.
Congress cannot drop charges that are being prosecuted by DOJ, and Biden/Garland will run the DOJ until at least Jan. 2025.
