New York A.G. Subpoenas Trump to Testify in Fraud Investigation (ALSO suspending her campaign)

Last edited Thu Dec 9, 2021, 01:07 PM - Edit history (2)

The New York State attorney general, Letitia James, is seeking to question former President Donald J. Trump under oath in a civil fraud investigation, according to two people with knowledge of the matter, an unusual move that comes at a critical juncture in a parallel criminal investigation into the former president.

Ms. James, whose office is also participating in the criminal investigation being run by the Manhattan district attorney, Cyrus R. Vance Jr., is seeking to question Mr. Trump on Jan. 7 as part of her separate civil inquiry into his business practices.

If Ms. James finds evidence of wrongdoing, she could file a lawsuit against Mr. Trump, but she could not file criminal charges.

But her request comes as Mr. Vance is pushing to determine whether Mr. Trump or his family business, the Trump Organization, engaged in a pattern of criminal fraud by intentionally submitting false property values to potential lenders. Mr. Vance, a Democrat, did not seek re-election and is leaving office at the end of the year.

EDIT to add:

Tish James is suspending her campaign for governor, per source. First reported by @ZackFinkNews

I have come to the conclusion that I must continue my work as attorney general.

There are a number of important investigations and cases that are underway, and I intend to finish the job.

I am running for re-election to complete the work New Yorkers elected me to do.

Let's not forget Letitia James is running for governor so this would be a huge feather in her cap. James is the real deal.

Requesting Trump’s testimony is a first step in a process that could eventually lead to issuing a subpoena and going to a judge to order him to cooperate if he were to refuse.

James’ investigators last year interviewed one of Trump’s sons, Trump Organization executive Eric Trump, as part of the probe. James’ office went to court to enforce a subpoena on the younger Trump and a judge forced him to testify after his lawyers abruptly canceled a previously scheduled deposition.

This is why I keep yelling that DOJ needs to get involved in the insurrection, it has more clout.

...people are going to start asking where the buck actually stops regarding the observed style of adjudication of the most horrid crimes against America.

Does it stop with Garland? His idea? Or was Garland *asked* to go slow until the economy is stabiized and Covid under control?

That would be understandable. Except that we're about to lose the republic because the traitors, conspirators, actors are not pausing while the economy is being stabilized and the virus brought under control.

And still no indictment for Trump.

I an hoping that Garland has a greater sense of urgency than Vance.

Or maybe his successor will need more evidence. We don't know.

Either way, I suspect balls don't figure prominently in the process of filing for an indictment.

And it will take years of appeals in court to enforce anything since his lawyers just file motions forever. Nothing will come if this.

James forced him to testify. This is state court I don't believe the federal courts or SC can bail Trump out.

Not that she wouldn’t be a good governor — it’s because she prosecuted Cuomo, then ran for his job, giving the appearance of a self-serving motive. These days, we can’t even give the right any room to criticize, whether deserved or not.

The investigations are much more important than who is governor, IMO. Good call, Tish.

Didn't he overvalue properties when seeking loans and then undervalue the same ones when filing tax returns? Wouldn't that be tax fraud?

but she is cooperating with Cy Vance who is supposed to be doing the criminal part. So they are working together. The civil part would probably mean Trump owes a heck of a lot of back taxes.
