(96,882 posts)It doesnt MATTER if he can be called back to service. This military is not going to deactivate him for the sole purpose of prosecuting him. If hes committed a crim, try him in civilian Court.

(20,937 posts)I posted Mr. Kirschner's statement in good faith that he made a valid argument (not a silly meme) given his military and prosecutorial background. He included an example of a case where the military did do that exact thing. If you have information to the contrary, please post, as I would not want to post anything that would be misleading in any way.

and because, as I said, its not going to happen. Military Courts exist to deal with crimes conducted by people under military authority. The fact that Flynn is subject to military recall does not mean that hes not a civilian today. If the military started recalling civilians to military service for the sole purpose of charging them with civil;Ian crimes, it would blur the role that the military plays in domestic civilian activity. And for that reason, the civilian Sec Def isnt going to let it happen.
Simple question: what crime has Flynn committed that cant be tried in a civilian Court?
