Gorsuch refused the mask when all of his colleagues chose to wear theirs. But let's understand what else is going on. Diabetic Sonia Sotomayor is told to stay home and participate by phone even as the unmasked Gorsuch - the very cause of the whole sorry mess - gets to freely go to the office every day, sans mask.

This would NOT be the case if the Supreme Supreme, John Roberts, simply employed some . . . . . I don't . . . . . JUDGEMENT, and told the unmasked cretin that HE needed to stay home.

But no, of course not.

Chief Justice doesn't mean he is in charge of the other Justices. He can't punish Gorsuch in any official way. Gorsuch can't be fired, suspended, or docked pay.

for the vulnerable person, Justice Sotomayor in this case, to remain at home. If you think about it, Justice Gorsuch would probably not be the only non-masked person she would encounter if she comes in to work. Not sure if that thinking is why Roberts did it this way, but it could be.

22. Accomodation under ADA could be given her.

She should ask for special accomodation under ADA. Type 1 diabetes is a lifethreatening condition and adds extreme risk for hospitalization, and poor outcomes if intubated. A special chair as far away as she herself thinks is needed to "social distance" from un-masked fellow employees should be offered her. She should not have to Zoom; the workplace needs to accomodate her.
