The NC State Board of Elections declared in a motion that it has the "authority to police which candidates should or should not be disqualified per Section 3 of the Fourteenth Amendment."
The board says it can disqualify Madison Cawthorn if he "engaged in insurrection."

This filing confirms that the North Carolina State Board of Elections is prepared to investigate Madison Cawthorn and remove him from the 2022 ballot if it concludes that he facilitated the Jan. 6 attack. It's a big deal.

(30,613 posts)2. It's right there in the Constitution (14th Amendment).
Every insurrectionist should be disqualified, and I don't care what the apologists here say.
This needs to be Federally enforced. We can't just keep relying on the states to do all the work of protecting democracy.

Dont Underestimate the Legal Challenge to Madison Cawthorns Reelection

What Does Madison Cawthorn Have in Common With Ex-Confederates?

On Tuesday, the beleaguered North Carolina Republican congressman asked a federal judge to block a challenge to his candidacy in 2022. The challengers claim that Cawthorn is ineligible to run because he allegedly facilitated the Jan. 6 insurrection, an argument with surprising force under North Carolina law and the U.S. Constitution. Rather than adjudicate this challenge through the normal process, Cawthorn seeks an injunction holding that federal law forbids the state from investigating, let alone disqualifying, his candidacy. But the legal team contesting his reelection has boxed in the congressman so dexterously that he has resorted to an argument of eye-popping gall and inanity: Cawthorn asserts that the Amnesty Act of 1872a shameful law that perpetuated white supremacy in the Southabsolves him of disqualification from office even if he engaged in an insurrection.
Yikes, Cawthorn is scraping the bottom of the barrel here. Question of the day: if he has done nothing wrong, why should he need amnesty?
