Judge Orders Eastman To Prove That He Has A Real Reason To Assert Attorney-Client Privilege Over Tru

The federal judge overseeing ex-Trump legal adviser John Eastman’s battle against the House Jan. 6 Committee on Monday ordered the lawyer to back up the attorney-client privilege claims he’s made as he seeks to shield his communications with ex-President Donald Trump and others from the committee.

Judge David Carter of the U.S. District Court for the Central District of California noted in his order that the Jan. 6 Committee had objected to Eastman’s privilege claims for 130 records (which adds up to 568 pages) of his communications dating Jan. 4 to Jan. 7 of last year. Committee lawyers have argued that Eastman hasn’t proven the existence of the official legal service that he claims prevents him from turning over the communications — he hasn’t proven that the attorney-client relationship exists.

“The Select Committee has repeatedly noted the significance of communications immediately before and after the January 6 attack on the Capitol,” Carter wrote. “Given the investigation’s urgency, the Court finds it appropriate to expedite its privilege review of the January 4-7, 2021 documents.”

The judge ordered Eastman to file a brief supporting his privilege claims for each document in question, plus evidence of “all attorney-client and agent relationships” he had asserted in his privilege log.

Judge orders former Chapman professor to prove Trump hired him

A federal judge in Santa Ana Monday ruled that former Chapman University law professor John Eastman must show proof he was hired by former President Donald Trump if he wishes to continue asserting claims of attorney-client privilege regarding his emails on the university's server.

U.S. District Judge David O. Carter set a schedule for attorneys to file written arguments regarding Eastman's claims of attorney-client privilege that would shield some emails sought by the congressional committee investigating the Jan. 6 insurrection at the Capitol.

Attorneys for the Jan. 6 select committee filed a motion on Friday saying Eastman has not responded to multiple requests for proof that the law professor was hired by Trump in a capacity that would allow him to assert attorney-client privilege. Without that proof, the committee argues in the motion, Eastman should not be allowed to assert the privilege and prevent the committee members access to the emails from the days leading up to and after the riots.

Eastman has sued the congressional committee to block Chapman University from releasing the emails. U.S. District Judge David O. Carter last month rejected Eastman's temporary restraining order request, clearing the way for the attorneys to go over the emails to determine what should remain secret and which ones can be sent to the committee.

Judge speeds up review of lawyer's emails sought by January 6 committee

Washington — A federal judge in California said Monday he will speed up the review of emails conservative lawyer John Eastman is seeking to withhold from the House select committee investigating the January 6 assault on the U.S. Capitol.

The order from U.S. District Judge David Carter in the Central District of California indicates Eastman is working to keep 568 pages of emails exchanged between January 4, 2021, and January 7, 2021, from the House panel, asserting attorney-client privilege and other attorney work-product privileges. Carter wrote that the select committee "has repeatedly noted the significance of communications immediately before and after the January 6 attack on the Capitol."

"Given the investigation's urgency, the court finds it appropriate" to speed up its review of the records, the judge said. Carter scheduled oral arguments regarding Eastman's justifications for shielding the communications, which are held by his former employer Chapman University, for March 9.

Eastman has emerged as a central figure in the effort mounted by Trump and his allies to reverse the outcome of the 2020 presidential election. According to the Washington Post, Eastman advised then-President Donald Trump, incorrectly, that the vice president had the authority to reject state electoral votes and overturn President Biden's victory in the 2020 election.

that could prove John Eastman was on the WH payroll. There would have to be paperwork and record of that for tax purposes.

Otherwise, Eastman is bucking for time.

Privilege is in place before talking but I’m old fashioned.

The post-truth world crew is too cool for these formalities.
