No details on whether the robbery victim was a legal gun owner, but with the extremely lax gun laws in Texas, most anyone is.
Very sad, say her name, Arlene Alvarez.
A man who was robbed at gunpoint at a bank ATM drive-thru on Monday evening pulled his own gun and fired shots at the robber, but instead struck a 9-year-old girl who was in the backseat of her familys vehicle, authorities said. The girl died Tuesday evening.
The child, identified by relatives as Arlene Alvarez, was shot around 9:45 p.m. Monday as her father drove her and her siblings by a Chase bank on Winkler Drive, near the 2900 block of Woodridge Drive in southeast Houston.

(59,522 posts)report of what happened, the guy was just itching to use that gun. The robbery was over, he and his date were in no bodily danger, and he decided to get out of his car and shoot out a nearby truck.
The man got out of his car and shot at the robber as well as a pick-up he believed he was escaping with.
However, the truck belonged to the Alvarez family who was going out for pizza for Valentines Day, KTRK reported.

(59,522 posts)He shot at the robber AND at a nearby pickup that he THOUGHT had something to do with the robbery but didn't. The little girl was in the truck with her family. They were going out for pizza for Valentines Day.
The guy who was shooting his gun at anything that moved should be charged with the murder.

It appears that the victim of the attempted robbery killed someone that was entirely unrelated to the robbery incident. So, he should be charged for that.
