There’s a silver lining in the James investigation in that it’s a civil case. Should it go to trial, the Trumps’ invocation of their Fifth Amendment rights CAN be used by a jury to draw conclusions about the defendants.

45. I'm not a lawyer, but if Trump

claims that any rights were violated, he would try to go to the SC. He is claiming that he should not have to testify in the AG's civil case against his business because what he says in the civil case could prejudice the criminal investigation that the NYC DA is investigating. He will claim that he is being forced to testify against himself.

I don't know how the higher courts will respond to that claim. Most comments on it that I've read say that he will lose on appeals, but I don't have the legal knowledge or expertise to say that they are right or wrong on that point.

At least in my experience, New York may differ.

Your attorney can object to questions, but you still have to answer and are not able to confer with the attorney while a question is pending. The only things you don’t have to answer are attorney client privilege related questions.

And refusing to answer, even based on the 5th, can be used against you in this case since it is a civil suit.

pleading the 5th in a civil case can be used against Trump in the trial. The prosecution can state the questions that were asked and how Trump replied. Taking the 5th can't be used against a defendant in a criminal trial.

The Appeals court should agree with the former court. If the Appeals court does not issue a stay I believe it's game on, Trump and spawn will have to testify.
