WASHINGTON (Reuters) - Democratic U.S. Senator Joe Manchin said on Monday he would not support a Senate vote to confirm President Joe Biden's pick for a Supreme Court seat if a vacancy opened up right before the 2024 presidential election.

Manchin, who often clashes with his own party, told reporters his view was consistent with his view when Republican President Donald Trump nominated Amy Coney Barrett to the Supreme Court a little over a month before the 2020 presidential election.

Manchin voted against Barrett's confirmation, though he said he had supported her nominations for a previous post. He added it would be "hypocritical" for him to support a similar move by Biden.

Ah well. Hopefully, it will come soon and it won't be as much of an issue. I don't expect Manchin to cooperate on anything anymore.

If there is evidence that he knew and kept quiet about it, could he be charged with conspiracy?

Of course he would not resign, but he is subject to the laws, too, so perhaps he could be pushed out.

Have charges brought against him for conspiracy with his wife's seditious activities. It would be difficult to rule on SC cases from a jail cell.

And he could argue that the exec branch has no jurisdiction over the operations of scotus, so he couldn't be prevented from voting.

There are only 3 ways to get rid of him: resignation, impeachment and conviction, or death.

At least given what we know now. We aren't at the stage of justice before the drum head. At least I hope we aren't.

But if he were to die of natural causes, I would be as giddy as they were when rgb died.

Thomas is scum, for sure, but replacing Roberts would mean Biden getting to appoint a new Chief Justice, which is a pretty bfd.

I'd settle for replacing any of the conservatives on SCOTUS, though. Just to get the numbers more even.

That roberts is more likely to step down than thomas. roberts isn't happy at how he is being pushed around by the newcomers. They are openly ignoring and over riding him. They have made him irrelevant by voting as a block.

He surely doesn't like that and it threatens to trash his legacy, which was never very good to begin with.

It would have to be an I've had enough moment of monumental size, but it is not out of the realm of emotion and revenge.

Thomas on the other hand would rather cut off his wawa than let biden replace him. It isn't going to happen. No matter what.

Just look at issues like conflict of interest, or outside income from speaking engagements, or even what might appear to be corrupt practices.

They just say they are acceptable to themselves and move on. Each member is accountable only to themselves. Doubly so since the senate will never convict one if impeached.

He's gotten the court to consistently issue these very narrow rulings. In 2021 we had a string of news articles about all these unanimous decisions the court was releasing. In fact, last term they had 20% more unanimous decisions than the average term.

I think Roberts, like many SC justices, has an agenda, and he's not going to stop until he addresses what's on his agenda.

Just because we like to read into every word and nuance of an opinion or a comment to see if there are any cracks, doesn't mean the justices look at it the same way. But Roberts is looking at what's happening from a different political viewpoint than we are.

He may see the coming rollback of Roe or Affirmative Action as unfortunate, but I don't think he's sees it as a catastrophe like we do.

I could see Sotomayor retiring as a form of protest at the coming decisions from the court. In fact, I'd say that's more likely than anything else happening in the short term.
