Second, as I've mentioned before, while the NC BOE has the AUTHORITY to remove him from the ballot, it is NOT going to want to assume the RESPONSIBILITY of deciding whether Cawthorn has participated in an insurrection. There's a specific statute addressing Insurrection, and as long as he isn't indicted/convicted, he won't be kept off the ballot.

(22,037 posts)The NC BOE is not going to assume the responsibility of keeping an incumbent member of Congress off the ballot. They would be tied up in court for a decade and it would rive the state.

The Constitution's 14th Amendment, which is the text cited in the OP meme, DOES NOT ban anyone from RUNNING for office. It bans folks from HOLDING office.
It's structured like Article II, Section 1 of the Constitution which specifies (in Clause 5) that to hold the office of POTUS a person must be at least 35 years of age. It doesn't prevent anyone younger from running for the office, it only prevents them from holding the office if they win.
Now, why are there restrictions on holding office but not running for office? Well, running for office involves things like public speeches, holding rallies (peaceful assemblies) etc etc... can we think of a part of the Constitution that might be violated if we banned someone from speaking publicly & holding assemblies? First Amendment, maybe?
Even in this specific case with Madison Cawthorn, I don't believe there's anything that can prevent him from running, Occupy Democrats has mischaracterized the issue at hand. The issue at hand is that, the North Carolina State Board of Elections allegedly has the power to prevent his name from appearing on the printed ballot. The question is NOT "can he be prevented from running," the question is "will his name appear on the ballot"?
Even if his name is removed from the ballot he can still run as a write-in candidate.
If I'm wrong on this please tell me, it's driving me nuts how 90+% of folks, including our media, are mischaracterizing this.
