Any attempt to legislate expansion of the SC that will ultimately be challenged in court so it would ultimately end up at the SC. How you rule on something like that without an inherent conflict of interest is anybody's guess. But apparently, that isn't an issue for Thomas so why should it be an interest for anyone else.

On the other hand, it is idiotic to ask any questions related to a particular hypothetical case.

Whether the challenge has validity or not, I don't see anyway it doesn't get challenged.

Once challenged, there always seem to be enough courts willing to pass the buck for these kinds of things to get to the SC. Once there, do you think the Conservative Six would let it stand? Do you think it would actually matter to them what the Constitution actually says?
