Freedom of Speech Amendment to our Constitution? Can he be challenged on that in the Supreme Court? What am I missing here?

(11,744 posts)As a government employee (school districts are the local government), teachers have free speech personally, but their ability to practice is limited at work (in school) by policy in the district and state approved curricula.
An extreme example from the other side would be a right wing teacher promoting Holocaust denial. That would likely lead to discipline and termination. Because it is couched in terms of curriculum, there is more leeway.
I am sure it is being challenged in court and it will likely end up being unconstitutional, but it will take time and effort to do it.
