Executive orders have the effect of law, but they only create requirements for the executive branch. They must relate to and be consistent with either a law already passed by Congress, or based on powers granted to the President in the Constitution.

8. Apples to Oranges. The 2000 SC did not actually call an election. They prevented a recount.

The results were almost the same, but totally different things Constitutionally.

Executive Orders are not laws; they only apply in limited circumstances where the Executive Branch has valid powers and responsibilities given to it by The Constitution.
