The third pillar of our esteemed federal system is entering a chaotic phase as the investigation heats up into the premature and embarrassing leak of Justice Samuel Alitos draft opinion that overrules Roe v. Wade. The focus at present is on the individual justices law clerksthe folks who actually do the lions share of the research and writing that informs the courts learned pronouncements.
As CNNs Joan Biskupic reports, apparently no one has yet copped to sending the Alito screed to Politico, despite what had to have been a tense meeting with Chief Justice John Roberts, who is busy watching his judicial legacy circle the bowl.
Supreme Court officials are escalating their search for the source of the leaked draft opinion that would overturn Roe v. Wade, taking steps to require law clerks to provide cell phone records and sign affidavits, three sources with knowledge of the efforts have told CNN.
Some clerks are apparently so alarmed over the moves, particularly the sudden requests for private cell data, that they have begun exploring whether to hire outside counsel.

Maybe Jonnie and federalist society could file amicus brief on the matter of privacy and then try to seek a subpoena and see how that would with these problem amendments. You know the first seven ....after all the country is about to get a a amicus brief on what witches and things did under abortions' laws...and if I was clerk would tell them to go pound sand.....

It's always put ex post factor ad hoc rationalizations with these types. They care about identity and their own power; nothing else.
