You have the "legal" circumstance of the D.C. Medical Examiner declaring this about Officer Sicknick, who died after getting bear sprayed-

Capitol Police officer Brian Sicknick, who engaged rioters, suffered two strokes and died of natural causes, officials say

Capitol Police officer Brian D. Sicknick suffered two strokes and died of natural causes a day after he confronted rioters at the Jan. 6 insurrection, the District’s chief medical examiner has ruled. The ruling, released Monday, will make it difficult for prosecutors to pursue homicide charges in the officer’s death. Two men are accused of assaulting Sicknick by spraying a powerful chemical irritant at him during the siege, but prosecutors have not tied that exposure to Sicknick’s death.

In an interview with The Washington Post, Francisco J. Diaz, the medical examiner, said the autopsy found no evidence the 42-year-old officer suffered an allergic reaction to chemical irritants, which Diaz said would have caused Sicknick’s throat to quickly seize. Diaz also said there was no evidence of internal or external injuries.

Diaz said Sicknick suffered two strokes at the base of the brain stem caused by a clot in an artery that supplies blood to that area of the body. Diaz said he could not comment on whether Sicknick had a preexisting medical condition, citing privacy laws.In the days after the riot, police and a Justice Department official attributed Sicknick’s death to his efforts to contain the riot.

Democratic House managers arguing for then-President Donald Trump’s impeachment said Sicknick was killed by rioters, citing a New York Times story that said police initially believed Sicknick had been struck with a fire extinguisher. The Times later updated the story saying there was no evidence of blunt-force trauma. But exactly what caused Sicknick’s death has remained unclear for more than 14 weeks.

So that hamstrings a prosecutor to charge homicide or manslaughter when you supposedly have no connection given by the ME, for the suspects' actions and the result.

The two who did this assault however, were charged, and have a trial coming up although apparently plea deals are underway and the trials have been delayed to October 5, 2022 -

WASHINGTON, April 11 (Reuters) - A federal judge on Monday postponed a June trial date for two men accused of assaulting police during last year's attack on the U.S. Capitol after an attorney for one of the defendants expressed optimism a plea deal could be reached.

Julian Khater and George Pierre Tanios had been slated to go to trial on June 6 on multiple criminal charges including assaulting at least three U.S. Capitol and Washington police officers with a chemical agent. U.S. District Judge Thomas Hogan agreed to reschedule the trial to Oct. 5 to give the parties more time to negotiate.

One of those assaulted, Capitol Police officer Brian Sicknick, died of natural causes following multiple strokes the day after the Jan. 6, 2021, attack by former President Donald Trump's supporters in a failed bid to block Congress from certifying President Joe Biden's 2020 election victory.

Khater, of State College, Pennsylvania, was arrested last year as he disembarked from an airplane at Newark Airport in New Jersey. Tanios, of Morgantown, West Virginia, was arrested at his residence in West Virginia. Khater remains detained. Tanios was released with strict curfew orders.

Aside from Sicknik, there were 4 other officers who sadly committed suicide.

but since they assaulted officers without regard, how about attempted murder.

The man arrested outside Kavanaugh was charged with that. Why not those who built the gallows and screamed Hang Mike Pence?

but I think because of that mention of Sicknick's "underlying conditions" and suggestion that the chemical irritant wouldn't have triggered the death, then that is why DOJ went with the assault charges. In any other circumstance, I would think something like "negligent homicide" or whatever the law is there calls it, might have been tried. But what happens is that if they go to a jury, there needs to be a "beyond a reasonable doubt" amount of evidence and the "doubts" are already publicly disclosed before they even get to jury selection (which is probably why all the plea deal maneuvers).

I think in the case of Kavanaugh, the suspect came there locked and loaded and we know what gunz can do (vs bear spray).

And with respect to the other examples, well that would probably fall under First Amendment, although there may be people we are unaware of (whether among the Proud Boys and/or Oathkeepers) who were actively seeking Pence out for that purpose, and those would be the ones possibly chargeable. And whatever went on with Pence's reasons for refusal to get into the limo (that hasn't been disclosed publicly yet), that might shed some light - if they actually bring that evidence out.
