Many former prosecutors have opined that DOJ should have run a parallel investigation in the Raffesperger/Trump phone call.
I believe the difference between Fanni Willis and Merrick Garland is that Fanni Willis believes a former president can be indicted, but Merrick Garland hasn't made up his mind yet.
Please don't respond with we don't know what DOJ is or isn't doing.
"There are certain actions, parts of these different lines of effort to overturn the [2020] election, that I don't see evidence the Justice Department is investigating," Schiff, a member of the committee and chairman of the House Intelligence Committee, said in an interview with "This Week" co-anchor and ABC Chief Global Affairs Correspondent Martha Raddatz.
DOJ isn't waiting to get ducks in a row, they are in a row. We are waiting for Merrick Garland to decide if it is proper to indict a former president.

(47,528 posts)I seriously doubt one man is deciding how the crime of the century will be handled. Especially when it means possibly prosecuting a former POTUS, half the US congress and a sitting SC justice and his wife. Way above his pay grade.
Typically in DC big decisions are made behind closed doors by very high level power politicians.
Then the public is spoon fed the decision, all cleaned up and presentable. Some high level people will be protected at all costs, others will be thrown to the wolves.
For example, McConnell may be happy to get rid of Trump, let Garland have him. But GOP Senators will not be touched, the senators who were active in 1/6. Supreme Ct may remain untouched as well.
Pelosi may have her own wish list as well.
As we look at consequences, we should be able to see whose fingerprints are on the decisions.

Do these high level power politicians have the means to bypass the GQP politicians? There are only 2 Republicans left in Congress, 1 is retiring and 1 is woefully behind in her primary.

I think the GOP is tired of Trump and and GQP nut jobs.
It will be very interesting to see how this unfolds.

(21,445 posts)When discussing whether Garland will indict Trump, Tribe gave a long pause before responding, "I hope so."
If Garland has already decided he will indict Trump he deserves a chapter in JFK's Profiles in Courage. I had a stint as a councilman in my local borough where I defended my town against powerful people. I had many sleepless nights, and yes, there were death threats and goon squads involved. I only bring this up because I got a small taste of the enormous pressure that is on Merrick Garland right now. I hope he stays strong.

Even Laurence Tribe said that Garland could be considering that indicting Trump could cause a Civil War.

(21,445 posts)No way Trump gets charged by the end of the month. Willis is running a special grand jury which has no authority to indict, it gathers evidence and produces a recommendation whether to move forward to a real grand jury.

Is he still making up his mind on whether it is proper to indict them as well, or is it that you just dont know what youre talking about?
Your singular focus on indicting Trump ignores the logical assumption that if Trump were to be indicted, his indictment would be preceded by the indictment of several, if not dozens, of co-conspirators.
So, all your posts about Garland being indecisive about indicting Trump are, as Shakespeare put it, sound and fury, signifying nothing
