“The chairman of the House select committee investigating the January 6, 2021, attack on the US Capitol told reporters Monday that the panel will not make any criminal referral of former President Donald Trump or anyone else to the Justice Department — a claim that met swift pushback from members of the panel.,” CNN reports.

Said Rep. Bennie Thompson (D-MS): “No, you know, we’re going to tell the facts. If the Department of Justice looks at it, and assume that there’s something that needs further review, I’m sure they’ll do it.”

But Rep. Liz Cheney (R-WY) released a statement contradicting the chairman’s comments: “The January 6th Select Committee has not issued a conclusion regarding potential criminal referrals. We will announce a decision on that at an appropriate time.”

And anyhow, a criminal referral from the committee is just a letter and it actually has no legal effect - it's basically political, and the DoJ can investigate and prosecute regardless of what the committee does. One talking head suggested that it would actually be better if the committee didn't send a referral because prosecution by the DoJ would actually seem less political.

In the last decade there have been dozens...

Can't think of one that was charged by the DoJ.

They can charge Trump without one after conducting their own investigation, and referring to the Committee's material too, which hopefully would eventually be shared with DoJ.

They should absolutely do so, along with several MoC. Whether weak-kneed Garland has the gumption is a whole other story.

The committee should simply lay out the facts, as they are doing.

A non-referral does not mean that the DOJ will not prosecute. By my way of thinking, the committee will have done all of the hard work, and the DOJ essentially just has to copy and paste their conclusions in order to support an indictment.

Liz Cheney is out for revenge, cause there's a bloodfeud over control of the Republican party going on here. The Neocons versus the Neofascists--these are both groups who go for blood in a fight.

She's hoping there's vindication for her shrinking faction in exposing the Trumpites as charlatans and crooks. And she's almost certain to lose her renomination. This fight will be her family's legacy, unless you count all the troops her daddy got killed in Iraq

if they really want to prosecute.

It all boils down to one man - the head of the DOJ -deciding to prosecute or not.
