Just hours before the House select committee was to begin its third televised hearing on the Jan. 6 Capitol riot, former president Donald Trump took to his Truth Social account to demand he be given air time on the same networks to lay out what he described as his evidence of "massive Voter Fraud & Dem Security Breach!"

He followed that up moments later with "I DEMAND EQUAL TIME!!!"

63. Sigh. The Fairness Doctrine had nothing to do with the Equal Time Doctrine.

The FCC’s Fairness Doctrine required holders of broadcast licenses to air controversial subjects of public interest, and to air differing views on those subjects. It did not require equal time for those views.

Scalia and Bork, on the DC Circuit struck it down. Congress then passed it as a statute, which Reagan vetoed. If it were still in place, it arguably would require airing opposing views to the hearings, but not equal time, and not necessarily by Trump.

Equal Time is not applicable to this situation. It applies to opposing political candidates. It requires stations which give time to one candidate to provide equal time, in a similar time slot, at the same rate, to his or her opponent(s), if requested.

There are certain exceptions, including bona fide news interviews and spot news coverage. Trump is not a candidate, and if he were, he wouldn’t be running for Congress against any of the committee members. And this is certainly an event deserving of spot news coverage in any event.
