It’s nuts here.
THIS is why I ran for office even though this County has not elected a Democrat in over 25 years. It’s why I recruited several candidates this coming election.

I’ve spent quite a bit of time in the county in question.

I find it especially vexing there’s only a little over 7k votes held up. There are quite a few more people than that who are eligible to vote in the area.

My personal perspective on this event is that it is a dry run or prototype to see what they can get away with in a general election. NM is of course a purple state in many ways. It may be the attempt is to see if enough rural red counties refuse to certify in a strategic manner that it will throw the election to their preferred candidates. Of course they will never say this out loud as the reason behind their actions and that is why there seems to be no reason.

The Cowpies for TFG dude has some national level contacts, so it is safe to assume he didn’t come up with this all on his own.

Actually I thought I had read he had resigned from the commission after his conviction for his J6 involvement. So I was a little surprised to see him leading the criminal actions.

A con-man, snake-oil salesman sold our county on an election audit…the grifter has now raked in over $300,000 on the ‘Christian’ go fund me site.

It really is nuts here. But we have two Democratic candidates where they count most-county and state representative.

Someone here on DU posted that if the county's results are not certified, NM will certify the election without the results of Otero county. (The rest of my reasoning is based on the idea that the post I read is true.)

By NM law, the County Commission must present specific compelling evidence that the election was not fair or that the voting equipment/tabulators were malfunctioning or were manipulated. Otherwise, they MUST certify the election.

If the election is not certified, candidates who are running for offices outside of Otero County would have to accept the statewide results minus Otero County.

Under this scenario, it seems to me that both the voters of Otero County and the candidates would have a claim that voting rights were violated. Absent a publicly stated and legally argued reason to not certify the election, voting rights are violated.

In such an instance, it would seem that the County Commission could be legally removed for dereliction of duty and violation of voting rights according to NM election law and possibly Federal election law. That would pretty much mean removal from office and possible jail time.

Again, all of this assumes that what I read here on DU is accurate.

I have no idea what mechanisms are in place (in NM) to address the issue of election races that are specific to Otero County. My guess is that any voter or candidate w/ standing could haul this issue into court.

the county will refuse to certify
the state supreme counted will order te votes to be counted anyway, ignoring the commissioners
the court will also order the commissioners jailed and removed from office
