https://apnews.com/article/2022-midterm-elections-us-supreme-court-pennsylvania-constitutions-north-carolina-b1aaaf54cda0deada714a4eb57643d94WASHINGTON (AP) The Supreme Court seems poised to take on a new elections case being pressed by Republicans that could increase the power of state lawmakers over races for Congress and the presidency, as well as redistricting, and cut state courts out of the equation.
The issue has arisen repeatedly in cases from North Carolina and Pennsylvania, where Democratic majorities on the states highest courts have invoked voting protections in their state constitutions to frustrate the plans of Republican-dominated legislatures.
Already, four conservative Supreme Court justices have noted their interest in deciding whether state courts, finding violations of their state constitutions, can order changes to federal elections and the once-a-decade redrawing of congressional districts. The Supreme Court has never invoked what is known as the independent state legislature doctrine, although three justices advanced it in the Bush v. Gore case that settled the 2000 presidential election.
The issue is almost certain to keep arising until the Court definitively resolves it, Justice Brett Kavanaugh wrote in March.
It only takes four of the nine justices to agree to hear a case. A majority of five is needed for an eventual decision.
*snip*
This could destroy elections.

(1,156 posts)The Scotus is irreparably damaged by partisan federalist society justices who are not qualified to adjudicate the important cases spearheaded by fascist right wing forces. The damage done by Moscow Mitch and tRump continues unabated.

(21,304 posts)there go my votes for Fetterman and Shapiro. I may have to change my mind and vote on election day instead of by mail.
Ratfuckers all of them. Should have at least tried to add 4 more justices.
I think that the SC is now corrupted and we need to expand the Court to compensate. It isn't that the present Court will not vote the way I personally prefer, it is just that, when you begin to think that the Court will only vote the way that the Repubs profit from, then you see idiotic decisions that suppress part of the citizenry for no good reason other than prejudice, then you must do something about it.
We can't trust the Court right now. And, they are picking issues to hear that will benefit the Repubs in Midterms and 2024. They are aiding the coup, IMO, and their reasoning is suspect.

You can disabuse yourself of that idea.

(6,513 posts)I never thought the likes of Trump would ascend to office, either, but here we are.
After the J6 hearings, when this committee has presented to the American people, the utter corruption of Trump and his followers, ie., the GOP, then a dialogue may open for the expansion of the Court. Or, term limits for the Justices. Also, if we took the majorities at Midterms, we might have a chance. Certainly, we need to counter the atrocious voting of those two Dem traitors who stand in our way.
I will not "disabuse" myself of the notion that action can be taken to defeat fascism. The SC is now corrupted, as demonstrated by Ginni Thomas, and unless Clarence Thomas steps down, we might as well attempt to expand the Court, or limit their terms so as to limit their damage to our Democracy.
This at least demonstrates the widespread corruption introduced into our governments both at state and Federal levels, and rooting out the corruption will take awhile. I am willing to wait as long as I see it happening. You need to have a little more confidence in the process.
