Donald Trump has "zero" defense against a criminal investigation into whether him pressuring Georgia Secretary of State Brad Raffensperger to tilt the election in his favor constitutes as election interference, said former Watergate prosecutor Nick Akerman on Sunday.
The ex-president is facing an investigation in the key swing state's Fulton County about whether or not his phone call with Raffensperger, whom Trump implored to "find" 11,780 votes to tilt the election in his favor, amounts to interfering in the election. The state's investigation is coupled with the House select committee that is investigating the attack on the U.S. Capitol last year, which is seeking to determine the extent of Trump's involvement in inciting the violence.
The committee's now-televised hearings have received much attention, but Akerman said during an appearance on MSNBC's The Katie Phang Show that the investigation in Georgia is more likely to "send Donald Trump to prison" because the tapes could bolster the prosecution's case against him.
"What is significant with those tapes is that when you put it in context of all of the evidence that the January 6 committee has uncoveredyou put that together, Donald Trump has zero defense in Georgia," he said. "If I had to put my money on one prosecution that's going to go forward here that will send Donald Trump to jailit's Georgia. No question about it."

(6,862 posts)Trump is psychologically and emotionally incapable of admitting to ANY personal loss, flaw or miscalculation. Simply being arrested would drive him so far over the edge it would be hard for anyone to ignore the pathetic weakness of character. But fear not, citizen Republicans, nurse Ratched will have him back in shape and ready for the hunt by 2028.

To slightly alter the phrase "better fight them over there than to fight them here."
I would suggest it's "better to incarcerate him over there than to have him close to plotting allies here."

(3,407 posts)Lets write the script in a positive way. Too many people understand the need for trump to go to jail, they understand that Democracy in the USA is on a tight rope, any hard wind and Democracy falls.
I am convinced that trump will either go to jail this year, or beginning of next, that SOB WILL NOT be running for office again.

(13,197 posts)Neither will, "I just want to find 11,780 votes." In the recording, he says "we won the state" or "we won the election," both before and after the bit about the 11,780 votes.
What "might" get him is Trump's nasty little threats against Raffensberger supposedly risking being charged with a "criminal offense." That sounds low, and juries would respond to the low.
Otherwise, the recording will be used by the defense in any case, state or federal. Trump repeatedly portrays a belief that he won the election. That can be used to undermine "intent."

(14,337 posts)There's also a thread on the Greatest page that has an aide saying she heard him admit privately he lost. So while Trump can claim he believed that he won, there is evidence to counter that .not to mention the fact that he actually did lose.

(6,573 posts)How is it that, just because he thinks he won, he can defend himself against charges of interfering with an election result by threatening an election official with criminal prosecution if he doesn't get his way? I don't see any change in the "intent" here. He clearly intended to change the vote, clearly threatened Raffensperger, and clearly intended for an election fraud to occur. And, there is clear evidence of that.
If that is his excuse, that he believed he had overall won the election, then he better get the search on for some free lawyer firm he can call his own. Everyone is entitled to a defense, but I don't think this will fly. It will be interesting to see how the SC will spin this set of facts to excuse his criminal intent. He ain't no Patriot, that's for sure.

(6,573 posts)Trump fed them a lot of reasons that they could claim as substantiation for changing the vote count. He's real slick, but they repeatedly responded that their numbers were correct. He then moved on to threatening them, first with criminality, then with lost campaigns by his withdrawing endorsements. But they didn't crumble at all in the face of the whirlwind he brought.
This was painful to listen to, as Trump says almost everything twice in a row. It is so wonderful not to have to listen to his crap anymore, but listening to this phone call is worth it. He really, really tried to corrupt the vote. I also wondered whether this Ruby person and her daughter could sue for defamation. Not up on that, though.

(21,645 posts)this crime was committed some 18+ months ago. And it was a single event, a phone call. The whole event lasted, what, maybe 15 minutes a the most? This isn't a months long conspiracy like the jan 6 terrorist attack. What in the world could they be investigating that they have not already looked into?

(6,573 posts)how Trump really didn't want her to speak? She kept trying to get the missing data from them, the records that are not allowed by Georgia law to be released, and Trump kept interrupting. He sure didn't want that data, because that data would show that the Georgia count was correct. That's not what he was interested in.
