(Reuters) - A Delaware judge on Tuesday rejected a motion by the parent of Fox News Network to dismiss Dominion Voting Systems Inc's $1.6 billion defamation lawsuit over the network's 2020 presidential election coverage.
Delaware Superior Court Judge Eric Davis, who last December said Dominion could sue Fox News Network, said the voting machine company can also sue Fox Corp on a theory it was directly liable for statements on the network.
Fox Corp did not immediately respond to requests for comment. In a statement, Dominion said: "We are pleased to see this process moving forward to hold Fox accountable."
Dominion accused Fox of trying to avoid viewer defections to conservative rivals Newsmax and One America News by amplifying false theories that the company rigged the 2020 election so Republican Donald Trump would lose to Democrat Joe Biden.

Delaware Superior Court Judge Eric M. Davis on Tuesday denied Fox Corp.s motion to dismiss the suit, saying Dominion Voting Systems had shown that the Murdochs may have been on notice that the conspiracy theory that rigged voting machines tilted the vote was false but let Fox News broadcast it anyway. Dominion cited in its suit a report that Rupert Murdoch spoke with Trump a few days after the election and informed him that he had lost, the judge noted.
These allegations support a reasonable inference that Rupert and Lachlan Murdoch either knew Dominion had not manipulated the election or at least recklessly disregarded the truth when they allegedly caused Fox News to propagate its claims about Dominion, said Davis, who previously allowed Dominions claim against the conservative news network to proceed.
Foxs press representatives didnt immediately respond to a message seeking comment. The company has previously argued that its reporting is protected by the First Amendment.

(25,539 posts)Many years ago somebody posited that there was a Fox corporation perpetual motion machine for idiots that works like this: the programming such as The Simpsons, Married with Children, Family Guy, That 70s Show, and In living Color for example is fundamentally subversive to the American way of life as conservatives see it. This programming causes young people to think rebelliously towards the establishment, and then Fox News comes in to save the day and rail against this kind of subversiveness. Of course, several of the shows mentioned above actually parody Fox News so it really must all be a game to them if they deposit their gigantic checks in the bank. Hopefully Dominion will be siphoning some of that off real soon
