Miranda WeakenedIf a police officer fails to give a suspect his Miranda warnings, and the gov't uses the suspect's un-Mirandized statements against him in court, can the suspect sue the officer for violating his Fifth Amendment right against self-incrimination? In a 6-3 ruling, SCOTUS says no.

This is as good a time as any to remind each and everyone of you to NEVER TALK TO THE POLICE EVER. You literally have nothing to gain and everything to lose. Its right there in the fucking Miranda warning- Anything you say can and will be used against you in a court of law.
It doesnt say Anything you say can be used to prove your innocence.
It doesnt say Innocent people never go to jail when they talk to cops
It doesnt say You can prove to these guys you are innocent if you just keep talking and telling the truth.

If they hassle you up on the street, and you have not committed a crime, don't say a word. Not one word. Let them arrest you and don't resist.
Edit: Even if you have committed a crime, just say you have nothing to say, and that you want a lawyer present. Nothing further. No sudden moves, no resisting.

It's a Catch-22 for a a lot of people, depending on your skin tone.
But even as a white guy, I wouldn't talk to them.
I don't buy the "not all cops are bad" thing anymore. too many examples of abuse. I've only seen one example where another cop (a woman) pulled a huge cop off a suspect for beating him up.
The "good cops" need to take a stand and stop this bullshit, or else they are not good cops.

(82,849 posts)We have a lot of trouble in my city of getting witnesses to cooperate when there's a gang-related shooting. Certainly witnesses are reluctant to cross gang members, who do a much better job of responding to events in their area than the cops do. But also, considering the neighborhoods where those shootings occur, the trust between residents and cops is badly broken, and residents don't want to take a chance talking to the cops.
The check on this ruling may come, oddly enough, from law enforcement and district attorneys who are frustrated in their attempts to solve crimes because nobody will talk to them.

As much as I drive, my interactions with law enforcement are minimal, but I know what to say as well as what not to say. EVERY SINGLE QUESTION a cop asks is an attempt to gather incriminating evidence against you. NEVER answer questions like Where are you going/headed? Or Where are you coming from?
Just answer I do not care to discuss my day with you.

Doesn't make any sense.
I have spent a good deal of time lately talking to a deputy. Its related to an issue in the neighborhood. Law enforcement is involved but theyre trying very hard *not* to arrest an elderly neighbor. We are all trying to get the neighbor the help they need, and m grateful for both the deputy and the county social worker for their efforts.
But yeah, lots of long conversations with the deputy.
On edit: folks need to use their best judgment. Not every interaction is bad, but the general advice not to say more than needed when approached or pulled over is good.
