Everything is executive privilege, national security, etc.
They would delay and delay enough so that even if they lose every argument, by the time donnie is sentenced, they would be able to argue that he's too old and sick for prison.
Not that I think there's much chance of it even getting that far in practice...

I doubt they'll invent anything for him. He might not even be relevant anymore a year from now. They've got other agenda that's way more important to the people who put them in.
