long since sailed. Will this case, or a future one, functionally "break" Marbury and cause the executive branch to decide not to allow itself to be told what laws and the constitution mean? IOW, where is the line at which we get a modern day real John Marshall-Andrew Jackson-quote moment where the executive branch simply acts contrary to the courts because that's where the preponderance of force lies? (Note: this would be bad)
