Every time this illegitimate SCOTUS comes out with another horrifying ruling I think of RBG, but especially today.
She thought abortion should have been decided on a different case, and based on equal protection, or sex discrimination, not privacy, because she said that basing it on equal protection wouldn't allow it to be overturned. Basing it only on privacy wasn't as strong a foundation. She said that only women become pregnant, so discrimination on that basis is a violation of equality.

(40,209 posts)Its being honest. RBG refused to retire because, and she said this herself, they wont get someone like me.
Ginsburgs stubbornness is the reason Amy Coney Barrett is on the court.
We need to just admit it.

(4,131 posts)The Republicans are cut throat when it comes to securing SCOTUS seats. If we dont practice even a little political pragmatism, we will never get the opportunity to fix this mess.
Political pragmatism is why so many good, strong Democrats were nearly screaming at Breyer to retire when Joe was inaugurated.
What if one of our Democratic senators had died unexpectedly during the last two years and had been replaced by a Republican Governor? Joe would have lost the opportunity to appoint Breyers replacement.
Make hay while the sun shines, FFS!

Thanks for recognizing this.

(5,306 posts)God knows I loved that woman, but she damaged everything she stood for by hanging around too long.
Thank God Justice Breyer is stepping down before the situation gets worse.
Now I have to pray for Clarence Thomas to have a massive heart attack.

(2,668 posts)but I don't know how she could have really thought that, know that no matter how long it took, several of them were trying to make this the cornerstone of their time on the SC.
How Sad is that, Justices on the court living their live to deny other Autonomy of their own health and wellness.
We have weak minded shitbags on the Supreme Court and we need to get rid of them or out country needs to make so much progress they become irrelevant.

(5,841 posts)What? You think McConnell would have allowed Obama to fill her seat?
You think Dem-picked justices would be in the majority TODAY if Obama replaced a left-leaning justice with another left-leaning justice?
You think the other side would have given up because Obama replaced a Dem with another Dem?
Think again.
That is pure fantasy.

(2,113 posts)It would still be a 5-4 conservative majority court.
If we want to throw someone under the bus, shouldn't it be Anthony Kennedy who retired in 2018 under Trump? IMO, that "retirement" stunk to the high heavens then and it still stinks today.

(5,841 posts)Obama would have replaced her with another liberal justice. Does anybody think the republicans in the Senate at the time would have confirmed any justice under Obama? Where the hell have you been? Scalia died in February and fucking McConnell wouldn't allow the seat to be filled by Obama because February was "too close to the election," which is something HE MADE UP. Oh but confirming Justice Handmaiden's Tale eight weeks before election day - when people were already voting - was perfectly okay.
You all have selective memories. Y'all don't remember this?
Besides, do the math. We'd still be in the minority and Roe still would be struck down.
Stop remembering a history you'd rather have and start paying attention to facts.

(5,841 posts)I can't believe you guys.
DO THE MATH. Even if Obama replaced her, we'd still be in the minority and Roe would still be dead. Let me explain it for the math-challenged: RBG would have been replaced with another liberal justice. We'd still be in the minority due to the stolen seat and Kennedy suddenly deciding to retire during a R administration. Not 6-3, but 5-4. Still a minority.
THiS IS NOT RBG's FAULT.
Shit.

(2,113 posts)The woman's dead and people are still blaming her for our lot in life. She had a brilliant legal mind and was a trailblazer for women in this country. She worked to advance the rights of not just women, but all Americans, literally her entire life. She was a hero.
The pro-choice position is that women should have autonomy over their own bodies and their own lives. But the argument here is that she should've retired when we say she should've?!? Please tell me I'm not the only one who sees the irony here. Look, I get that the timing of her death was inconvenient for us. I'm thinking it was for her and her family as well.
There's plenty of blame to go around but this isn't on RBG. Get off her back, FFS.
Novara
(5,841 posts)I mean ... FUCKING THANK YOU.
Sheesh.
RBG was a saint, man. All her life she fought for the rights of others. All her life. She had a brilliant mind up until the end, and we all benefited from her tenure as a SCOTUS justice.
Polybius
(15,385 posts)You just said that Mitch would have blocked her appointment anyway, so I merely corrected you.
I fully agree that RGB should not have ever been pressured to retire. It should be solely her decision.
