If accused, they'd say, "I wasn't lying at the time of my confirmation hearing when I said I didn't think Roe should be overturned, but after reading the briefs and hearing the oral argument in Dobbs I changed my mind." That's bullshit, of course; they were all hand-picked by the Federalist Society and vetted carefully to be sure they would vote to ditch Roe, but it would almost impossible to prove they were lying.

I haven’t seen a single case cited where someone was charged and convicted of perjury for something contradictory they did AFTER their testimony. Perjury is prosecuted based on statements about past actions, not future ones because all a person has to do is say “I changed my mind/opinion on the matter after my testimony”.
