(4,131 posts)It seems clear hes referencing how Brown overturned Plessy, and trying to make a point that there is historical present for long standing bad decisions being overturned by good ones.
I dont agree with his point because I think Roe was a good decision and that Dobbs is a bad decision, but he (obviously) isnt saying we should go back to segregation.
Cornyn may even wish we would go back to segregation. But that isnt what hes saying with this tweet.

Ordinarily, precedent is overturned in the direction of expanding and extending rights and liberty, not narrowing it.

(115,679 posts)to to overturn Plessy many years later in Brown, then why are people complaining about overturning Roe in Dobbs? But because Cornyn is a moron, he seems not to understand, first, that the Supreme Court overturns prior decisions only if there is a very good reason to do so, usually because there has been a significant change in circumstances or national will - clearly the situation in Brown, but not in Dobbs. Nothing has changed since Roe was decided that would indicate any need to overturn it; the opposite is true: for 50 years women have relied on the availability of abortions if necessary, which has markedly improved their economic and social circumstances. Second, Brown negated the pernicious separate-but-equal doctrine established by Plessy, and bolstered the right of Black children to receive an equal education in integrated schools. Dobbs did the opposite: it actually eliminated a Constitutional right - something that has never happened before.
But, as previously mentioned, Cornyn is a moron. The fact that he actually has a law degree and should have understood the yawning abyss between the two examples suggests that he slept through con law and hired someone to take the bar exam for him.

(82,849 posts)Plessy set up the "separate but equal" regime that failed miserably for decades, giving the force of law for Black people to be separated from the rights and privileges of society. Their "equal" public institutions and place in society was underfunded, overworked, unvalued, underpaid, and when Black people did manage to scrape together some generational wealth, it was forcibly taken from them. Cf. the Tulsa race massacre and Bruce's Beach in Manhattan Beach, California.
The situation remained intolerable for nearly 60 years before a clear majority of the United States finally shook itself free from the racism that dominated its national history and moved to change society to a fairer arc.
Roe, on the other hand, recognized a person's right to bodily autonomy and gave women control over their own lives in a way they had never had before. It was reversed by a minority that lied, cheated and stole its way into power against the clear will of the people of the country. It was reversed by a minority operating as a medical authority when it had no medical expertise to decide that it knew better than any woman, every woman about her own health care.
If you can't see the difference, Senator, you're every bit the stone-brained idiot I've taken you for all these years.
