Thomas writes that he would grant review to revisit the Sullivan "actual malice" standard for defamation. "This case," he writes, "is one of many showing how NYT and its progeny have allowed media organizations and interest groups 'to cast false aspersions on public figures with near impunity."

This was a case in which a Christian non-profit group sued the Southern Poverty Law Center for designating it as an anti-LGBT hate group, and AmazonSmile excluded Coral Ridge from participating in the program based on that designation.

I'm amazed he's unaware of how much worse the media was in the Founders' time. They basically had entire newspapers devoted to calling each other goat fuckers.

With the order list under our belts, I have time to post my list of the seven as-yet-undecided cases:
Justices enter the last week of June with seven cases to go

The Supreme Court issued two decisions on Friday, including its landmark decision overruling Roe v. Wade and Planned Parenthood v. Casey. But the justices still have seven more cases left to release before they leave for their summer recess, involving important issues such as religion, the major questions doctrine and whether the Biden administration must... A pro se motion making it all the way to the Supreme Court, wow;
"In 2019, Concepcion filed a pro se motion for a sentence reduction under the First Step Act. He argued that he was serving a sentence for a covered offense because §2 of the Fair Sentencing Act modified the statutory penalties for his conviction under 21 U. S. C. §841(a)(1). Concepcion contended that retroactive application of the Fair Sentencing Act lowered his Guidelines range from 262 to 327 months to 188 to 235 months."

The petitioner in the case is Xiulu Ruan, an Alabama doctor who specialized in pain management. The government contended that Ruan had prescribed medicine outside the standard of care for example, prescribing opioids when physical therapy or a detox facility would have been more appropriate. Ruan countered that he had always acted in good faith, making individual assessments of what each patient needed.

Third, and last, #SCOTUS opinion is Ruan: Justice Breyer writes that, under controlled substances act prosecutions, the federal government must show that doctors knew they were acting (or intended to act) in an unauthorized manner https://supremecourt.gov/opinions/21pdf/20-1410_1an2.pdf

I'm surprised that we are still waiting on WV v. EPA. Does anyone have any thoughts / speculation on why we are waiting to the very last on that case?
