Washington, 85 F. 3d 1440, 1444 (CA9 1996) (OScannlain, J., dissenting from denial of rehearing en banc). None of these rights has any claim to being deeply rooted in history. Id., at 1440, 1445.

The Trump familys gold-rush story began when Fred, as he was known, left Germany at the age of 16 with little more than a suitcase. Even though it might be debatable that Frederick Trump actually was a pimp, it is clear that he allowed prostitutes to operate in his hotel, both in Bennett and in White Horse before he cashed in and went back to Germany - where of course he was deported for never performing his required military service.

People's autonomy is legally limited in all sorts of ways. And laws against prostitution and possession of (some) drugs are illustrative examples in this regard.
Basically, that's the point of what he's writing.
Personally, I think all three should be legal ... but I get the argument in play here.

These two examples of 'bans' that restrict our autonomy are in fact, two of the best (i.e. closest) analogs ... to abortion bans.
Convince me otherwise by showing me that there are clearly-better examples?
Old anti-sodomy laws are arguably the next best, but those were struck down by SCOTUS, so wouldn't make a good example.
Maybe you have some better ones tho?

(4,131 posts)Folks should be free to choose how to live their life and should have bodily autonomy. If someone chooses to use illicit substances, or chooses to be a sex worker, or chooses to have an abortion, those are all choices that they ought to be free to make for themselves.
The government has no business regulating the bodily autonomy of women or anyone else, nor should it be able to criminalize what choices we make with our own bodies.

His argument is that we already restrict autonomy in various ways, both for males and females, and the right of the government to do so is established, and hence ... the government can restrict abortion under a similar principle.
For the record, I support ending the war on (some) drugs, and legalizing sex work ... and abortion on demand.

Like I pointed out elsewhere, men don't have autonomy over themselves. The government can still call you up to serve in the military (or do alternative service if you're a conscientious objector). They haven't done it in a while (those in my birth year were the last to face it), but they're entitled to by statute. Face it; whether you're male or female, your existence is at the government's pleasure.

The 10th Commerce Clause: "Congress may not use its commerce power: (1) to regulate noneconomic subject matter; (2) to impose a regulation that violates constitutional rights, including the right to bodily integrity;
Bodily autonomy is bodily freedom from serving "state" interests. The 13th: "Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction."
Bodily autonomy is bodily freedom to be left alone. The 14th: "All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
Bodily autonomy is under Natural Law. The 9th: "The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.
Bodily autonomy secures ones Life, Liberty and Property. The 4th: "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized
Bodily autonomy is the bodily right to free speech. The 1st:

Their's is a state of denial unlikely to adjust so long as their delusions remain supported by their perpetual nod to scientific non-truths. It doesn't help their education that their psychical and physical needs are met, maintained and manicured to levels enjoyed only by the world's entrenched 0.001% elite. Since they are currently incapable of rising above these handicaps, they must be removed, with prejudice adequate for the effort, if necessary.
Get them and their goddamned religious nonsense out of our government and give them a serious time out until they can do better.

The Courts Majority is clearly unable to even comprehend Roe v Wade. If you read Roe you will see that every single thing that these very limited people throw at it are false. It is an outrage along with being insulting beyond belief.

(73,537 posts)Recently, I've been thinking about these recent attacks in the context of science versus religion. Not all religion, but the supersitions of the republican right. For many decades, they focused their attacks on evolution -- no coincidence that this reared its ugly head when women's rights and civil rights were making advances. In the era of Trump, they started attacking the science of health care, which they will not limit to covid or abortion, but expand to birth control, etc.
This is a dangerous time.

Fun anecdote: I was reading Zero Fail, about problems in the Secret Service in recent years. An agent in the advance party preparing for Obama's visit to Colombia hire a prostitute to come to his hotel room, since prostitution is legal in Colombia. He refused afterward to pay the agreed-upon rate; she left and went to the nearest police station to file a complaint - because prostitution is legal in Colombia and she had some recourse. A police officer showed up at the agent's hotel to arrest him, and she got her money.
