(25,471 posts)Kavanaugh already weighed in on the issue in the Roe decision and clearly indicated that trying to prosecute women who traveled to another state would violate the right to interstate travel. This is just a variation of that. The Constitution is pretty clear on the issue.

(20,136 posts)and 2) This isn't about whether Texas can regulate women traveling. It's about whether they can prohibit companies in Texas from paying employees in Texas for it. This SCOTUS will say they can because it's purely within the state. I'm not agreeing with it; I'm saying that is how they will justify it.

(25,471 posts)If he had any inclination whatsoever to overrule the 14th Amendment in a future case, there would have been no reason for him to include the statement in the Roe decision. It wouldn't make any sense. As horrible a human being as he is, I don't think bait-and-switch just for kicks is on his agenda.
It's not purely within the state. They are still trying to influence actions that occur in another state in which they have no jurisdiction. Secondly, they would be penalizing a company for providing something that is perfectly legal.
I think it's unlikely that it withstands a legal challenge.

Justice Brett Kavanaugh, who emerged Friday as the Supreme Courts pivotal vote on abortion, said states outlawing the procedure may not bar residents from traveling to other states to terminate their pregnancies.
May a state bar a resident of that state from traveling to another state to obtain an abortion? he wrote in a concurring opinion. In my view, the answer is no based on the constitutional right to interstate travel.
Kavanaugh also said he didnt believe a state could constitutionally impose liability or punishment for an abortion that took place before the courts ruling Friday. He said that practice would violate either the Constitutions due process clause or the ex post facto clause, which bars retroactive punishment.

Especially disfavored are laws which discriminate on their face based on state residency.

It's weird and pervy. What next? Will they start encouraging men to go out and rape strangers to get the numbers up?
So glad I left there. Cannot believe this is America. WOuldn't mind one bit if they seceded.
