After the first selection consist of three from previous selection and four that had not been selected before. And could not be selected to more than two in a row.

It would need more tweaking to balance it out.

The last time SCOTUS numbers changed, to 9, it was because it had the responsibility to supervise 9 lower courts. There are now 13 of those lower courts.

I could be sold on further saying President Biden could appoint 2 and then one for each of the next 2 presidents. It would not immediately flop the court and would give Chief Justice Roberts a chance to remake the center and restore some confidence in the court.

If the Court were shrunk, Justices would most likely have to be cut/reassigned in descending order of seniority.

As of today, that would leave Thomas, Alito and Roberts.

This nonsense where one retirement, one death, one appointment can mean a total upheaval of our laws and precedents is insane.

This way, we would have a Supreme Court that at least somewhat reflects the Will of the People and that is designed to adapt to the times.

It would also dilute the political ramifications of a single appointment.

If that mean a Supreme Court of 50, 60 Justices, so be it. If they want to do a lottery to determine what Judges hear a case, that is fine. If they want to have every Judge listen to every case and have an equal vote, that would be OK, too.

Each POTUS gets 1 pick per term, maximum 2 picks for 2 terms.

Each POTUS term the longest serving justice is the one replaced. With 9 justices & 4-year POTUS terms that would mean each SCOTUS judge would serve 36 years.

It will probably never happen, but it's more equitable than the method we have now, IMHO.

Republicans won't let DC be a state, even though it has more people in it than Wyoming. The reason DC is not a state is Republicans know it will add 2 Democratic Senators. Same with Guam, VI and PR Republicans want a stacked deck, not a level playing field. They can't win or control Congress if it's a level playing field. They like how a minority of the population (namely, conservative rural white people) are overrepresented right now in Congress, and want to keep it that way.

we're not talking about evolution of a nation but one president's decision. This one learned more about all these issues decades ago than most of us will ever know and has kept advancing his outlook ever since.

He no doubt knows what combinations of changes in factors he would want to see to change this position, as well as those related to various other actions that can be taken.

That's my fear with expanding the court now - we take it to 13 and let Biden choose four justices and it'll be awesome for our side; then the next Republican fuck president or congress expands it to 27 and chooses 14 new ones.

and legal principles all Americans grew up. What we feeling without thinking as "The American Way." And that's good of course.

Biden badly needs Democratic majorities in congress that can take action. Including strong enough to consider possible legislative alterations to SCOTUS, only one of which is expansion. Making impeachment actually doable is desirable also; right now the Thomas majority isn't scared of them.

but the 6 unelected, unaccountable spokespeople for the fascist minority needs to be stopped. The decisions last week make no sense. There is no continuity in the rulings-just whims. I felt like when they ruled that the Stay in Mexico law could expire, they pulled the wrong slip of paper out their asses.

I have lived 2/3s of my life with EPA regulations. I've lived 2/3s of my life with abortion rights. Most of my life with Miranda laws. I have lived my whole life with separation of church and state. Right now, it is like doing a crossword puzzle and the down answers are listed first instead of the across answers. It is WRONG. ALL WRONG.

The 6 fascists on the court have to be stopped. Whatever recourse we have to reverse this enemy's course, we have to take it. They have turned my country into a smoldering wreck in just days. The minority of fascists and their minions on the court have destroyed my country just as badly as if they had turned missles on it.
