Legal experts believe that Fox News could be in real trouble for spreading baseless conspiracy theories about Donald Trump's election loss.
A judge ruled last month that Dominion Voting Systems could move forward with its lawsuit against Fox Corp., the conservative news network's parent company, for amplifying bogus claims that it rigged the election for Joe Biden, and Judge Eric Davis made clear the $1.6 billion suit was not frivolous, reported The Guardian.
These allegations support a reasonable inference that Rupert and Lachlan Murdoch either knew Dominion had not manipulated the election or at least recklessly disregarded the truth when they allegedly caused Fox News to propagate its claims about Dominion, Davis said in his ruling.
That doesn't guarantee Fox News or the Murdochs will be held liable, but legal experts agree the suit poses a real threat to conservative networks that spread the conspiracy theories.

(13,168 posts)It's not like these people were "theorizing" in the sense of there being some kind of evidence driving some kind of rational analysis. They were taking something that wasn't factual and spreading it around. At some point, that kind of "reckless disregard" becomes actual malice. There's a negative emotion behind the reckless disregard, malice. That makes the calumny intentional and the result of actual malice.
We wouldn't say that someone who drove his car on the sidewalk and hit pedestrians was "recklessly disregarding" traffic laws on the "theory" that sidewalks were really meant for cars.

(1,654 posts)With their tight control and canned mandatory "commentaries" from Nazis like Sebastian Gorka and Boris Epshteyn, etc. Those smaller stations have a lot of influence in smaller markets and should be held accountable for the damage done.
It's kind of sad when you consider that in this country corporations can sue for monetary damages done to their businesses singled out by deliberate lies by people like Trump and his cable toadies and the US public can't hold them to account for the harm done to our whole system of government by their lies because we apparently don't have standing.

No way is Fox News ever going to be in "real trouble". Or that this poses "a real threat to conservative networks that spread the conspiracy theories".
This is what they will say: Shows like Tuckers are only innocently asking questions. Its not criminal to end with "if this is all true maybe you should be very concerned!" Or bring on some guest who lays out the CT and Tucker only nods with a worried furrowed brow.
I do wish that the designation of the term "News" could be regulated though. There should be strict regulations on lying to the public or stoking unproven conspiracies and still calling yourself a news network. A network that has the term "news" in it should have limits on how many of these aggresions they can make before their licence is pulled.
