It was a power taken by Justice Marshall in Marbury v. Madison and honored by subsequent administrations with the lone
exception of "Old Hickory" Andrew Jackson in the Worcester v Georgia (1832) in which the indigenous "Civilized Tribes" fought against removal from their native Georgia lands. "John Marshall has made his decision, now let him enforce it."
Thus began the infamous "Trail of Tears" which saw 4000 Cherokee die along the way to Oklahoma Territory.
