(69,854 posts)1A violation, with the possible exception that the person who put up the flag was a renter, and the house owner called for its removal. The lease will sort that out.

Not that I would because I think that sort of vulgarity displayed in front of a home is trashy. But to each their own.

A Texas man has shared a video purportedly of a police officer taking down an Fk Joe Biden flag from his property while no one was home. ... Michael Prather, who says he lives down the street from the mayor, uploaded to TikTok what appears to a doorbell cam video of the cops alleged unilateral FJB banner ban.

Prather claims that the same officer noting the profanity warned him back in October on behest of the police chief, when he first unveiled the FJB flag, that he, Prather, could face a disorderly conduct charge unless he took it down.
Prather insisted at the time that flying the flag was a form of protected free speech under the First Amendment to the U.S. Constitution, and that hes willing to sit down with local authorities to discuss the situation. ... He also claimed that the officer told him flying the same flag on his pickup truck was acceptable.
The Texas man says he has contacted nine different attorneys, but so far none of them expressed interest in representing him in a potential legal case. He also pointed out that his home is not situated in a subdivision subject to any restrictions imposed by a homeowners association.

This is becoming a bigger and bigger problem in the U.S.. Civil representation is nearly impossible to secure unless the potential awards are in the six or seven figure range. I just roll my eyes these days when people exclaim "sue the shit out of them". It just doesn't happen.

The specific violation here is the repeated public and prominent use of the F word. This is an ordinance that has been on the books in most communities for decades.
Lies are perfectly legal, though, so at least F word dude has that going for him.

(69,854 posts)the First Amendment has been full incorporated by the Fourteenth Amendment, so when they say "Congress shall make not law...," they mean "Pottsboro, Texas, shall make no law..." too.
