(9,354 posts)You might want to say that, for instance, overturning Roe didn't make abortion illegal. But in many states - I believe over half - that's exactly what it dod, because of the trigger laws in place which went into immediate effect.
Sure, you could nitpick some of those things on technicalities. But the overall effects are exactly as described.

(8,199 posts)...don't fully understand the nuances of the cases & the nuances of the law.
I hate to say that, & I'm probably going to get criticized to no end for saying it, but it's true. Our media grossly misrepresents many court decisions, I'd say the majority of MSM news stories about major court decisions are wrong in significant ways, & then folks like this guy repeat & exaggerate those mischaracterizations. I try to help, but I get tired of explaining the same things over & over.
Should I start a blog so my friends to refer to my material? Perhaps I should. Years ago I had my own web site where I published all my research & writing about the Project for the New American Century & how they wanted 9/11 so they could use it as an excuse for the Iraq invasion, more than enough for a book, because at the time my goal was to publish a book. I'm thinking I should just have a blog so I can refer folks to it.

Bottom line, Congress screwed up. Law professors at major law schools were writing extensive analysis of this problem, & the potential consequences, back in 1994, at least that's one of the earliest I've found.
Previously lower courts gave Congress the benefit of the doubt even though they contracted themselves in the bill, but we finally arrived at a SCOTUS who said "Congress, it's not clear exactly what power you intended to give the EPA, so we're making this decision & Congress it's up to YOU to clarify what you intended."
Nothing was made illegal. Nothing was prohibited. Congress just screwed up & made a stupid editing mistake when reconciling House & Senate bills, & Congress can 100% fix their mistake if they care to.
Instead of spreading untrue information & bitching, it's MY-HUMBLE-OPINION that we should focus on understanding the facts & pressuring Congress to fix their damn mistake. But that's just me... *suffering from COVID & tired*

Except ...
We can NO LONGER SUE law enforcement for violating our Miranda rights.
Which means law enforcement can purposely neglect reading our rights, and get away with it. That's playing games meant to hurt people like us. Grrr ...

If anything can convince him (and the voters) this court will.
We just have to make sure Republican legislatures don't overturn it if we win

(41,631 posts)Chump got to add 3 ultra-conservative judges to SCOTUS which is more than any President since FDR. Joe Biden gets Ketqanji Brown Jackson and who knows what will happen in the next election? Even if Biden wins, he may not get to nominate any more Supreme Court justices during his 2nd term.
All we can do is hope for somebody (Thomas?) to resign, or else keel over and die.
Pro Tip: he won't resign as long as a Dem is POTUS.
It's not a pleasant thought.

(714 posts)Any court which has made it illegal to wear a hat with a large amount of fake fruit on it has definitely lost my support.
The rights were firmly established in Hedda Harper v. Carmen Miranda in 1941, if I recall correctly.
