(9,162 posts)The Kansas right to abortion is based on a 2019 Kansas Supreme Court decision interpreting text in the Kansas Constitution stating:
All men are possessed of equal and inalienable natural rights, among which are life, liberty, and the pursuit of happiness."
The Court held in a 6-1 decision that the quoted language gave a woman the right to choose.
Four years ago, the Iowa Supreme Court held the Iowa Constitution also protected the right to abortion. Six weeks ago the Iowa Supreme Court, with 3 new members, held there was no such right guaranteed by that same Constitution.

(21,425 posts)remove the right to abortion in Kansas. But, the people's voice has been heard. It should have consequences in the primaries this year and in future elections, giving us the numbers to codify abortion rights on the federal level. (Also to change the SC composition if necessary.)
So, this vote is still a good sign. May it be a forerunner of voting patterns this year.

(3,977 posts)But the people of the various States may evaluate those interests differently. In some States, voters may believe that the abortion right should be even more extensive than the right that Roe and Casey recognized. Voters in other States may wish to impose tight restrictions based on their belief that abortion destroys an unborn human being.
