Teri Kanefield: WHY the DOJ and FBI can't talk about an ongoing investigation.

More demands that the DOJ talk about an ongoing matter⤵️

Now I'll show you a reason WHY the DOJ and FBI can’t talk about an ongoing investigation.

Defense lawyers get it. Screenshots will be from a motion to dismiss (written by @reichellaw)

Top Republicans press DOJ for answers on Mar-a-Lago search
Sen. Mitch McConnell called for a "thorough and immediate explanation."

If the prosecution talks, defense lawyers file motions like these, which can lead to dismissal of the indictments.

Maybe that's secretly what the GOP leaders want, but good prosecutors really don't like getting their indictments dismissed for prosecutorial misconduct.

2/

It was interesting to see the GOP leaders start heckling the DOJ to talk.

Until now, the demands for answers came from Trump critics who were demanding that Merrick Garland update the public on the progress of the investigation.

3/

The shift is because the investigation has become public.

It's pretty clear that the DOJ did as much as they possibly could behind closed doors before finally letting the cat out of the bag by grabbing the phone of a sitting Congressman and searching Mar-a-Lago.

4/

While the investigation was happening entirely behind closed doors, Trump critics felt frustrated.

Sensationalists had nothing to say. 'We don't know anything" is boring so they went with "Garland is too wimpy to do anything."

Now Trump supporters are frustrated.

5/

At this point I think it's safe to assume that the DOJ prosecutors will just ignore them all.

I forget whether it was Monaco or Garland who said "we speak through our indictments."

6/

Thanks. Forgot to add that the defense can talk.

Which reminds me: I remain skeptical of all the reporting of what the search of Mar-a-Lago was about because all info is coming from Team Trump and Trump is a liar.

authorities searched the premises, specifically for evidence of certain items listed in the serving papers.

It's funny that they (the MAGAs/maggots) seemed to all leap towards this search news like they were on their last gasp of air, and dying for more air, anything to keep their faith in the orange anus alive. It's like the last set of embers dying out in a fireplace, bit by bit, and slowly, the fire starts dying out, flares up occasionally, but the inevitable still will happen, the flames will go out, the sparks will die out, and the smoke will drift away.

They're getting desperate. Note, on quite a few occasions, I've heard them exclaim that he's done a lot while he was in office. My question is WHAT? Other than passing the 2017 tax cut and jobs bill, I can't recall anything, anything else at all that he has done. The biggest thing I recall personally is him playing golf for over 300 times while he supposedly was in 'office', if you can call it that.

Looks like he totally consumed in coming up w/ various plots to remain in office no matter what it involved, illegal or not.

It means Garland is running a tight ship, a refreshing novelty given the clown show under Barr and tfg.

Kanefield hit the point: tfg critics found DOJ silence frustrating over the past months because it seemed the DOJ was not investigating. Now that there's been some action, tfg supporters are unhappy. (Boo hoo.)

The hermetic seal DOJ has had over this is a good thing, frustrating to one side or another depending on circumstances, but still a very good thing.

Replying to @Teri_Kanefield and @reichellaw

The only reason the GOP wants the DOJ to talk about the investigation is so they can find out if/when a warrant will be executed on their homes.

Bingo. The GOP doesn't care what the public knows or when it knows it unless there's media fodder to rile the base. What they really want is information about who is going to be in hot water next. They won't get it.

This is where the frustration we've all felt will be worthwhile in the end. No leaks? Good.

The payoff at the end of the investigations is the real prize.

There's an on-going investigation. There is no need to tell Kevin and Mitch what is going on if they cannot see. A private citizen (a former president) was holding classified documents and was refusing to turn them over. Some may have been related to national security. If they do not have a problem with that, then they should resign from the Congress immediately. There is no need to tell them anything at this time, during an ongoing investigation.

On top of that, if they know there is an ongoing investigation, and they still want him to be the nominee of their Party, and he is indicted after the midterm elections, they have no one to blame but themselves.
