doing any special investigation on your own as a senator from South Carolina into voting in Georgia.
RESPONSE IN OPPOSITION TO SENATOR LINDSEY O. GRAHAMS SUPPLEMENTALMOTION
Following this Courts denial of both his motion to quash the subpoena issued to him by the Fulton County Special Purpose Grand Jury and his Motion to Stay proceedings pending appeal, Senator Lindsey O. Graham filed a second Motion to Stay in the Eleventh Circuit Court of Appeals. The Eleventh Circuit granted a temporary stay in order for this Court to address the question of whether Senator Graham is entitled to partial quashalof his subpoena. This Court ordered the Senator to brief the issue and ordered the District Attorney to respond. In short, Senator Grahams repetition of his previous arguments does not entitle him to partial quashal, and the District Attorney respectfully requests that his motion be denied.

However,even if informal investigations by individual members of Congress are protected under the Speech or Debate Clause, the record does not establish that the phone calls were a part of any such investigation by Senator Graham.
