The DOJ and the intel agencies need to figure out what Trump's done with these documents. But she acts like this is something that will damage Trump? Well, yeah, if he sold documents, it SHOULD damage him.
But there's no reason that there would be any privilege anyway on those documents, because they weren't his, they weren't his lawyers.
The "privilege" is that "if the DOJ can't have them, it'll delay the time Trump's actions are clearly known."
I hope the 11th Circuit has some rational judges who rationally beat her about the head with scorn and contempt.

(2,499 posts)Cannon also gave Special Master Dearie until the end of November to review all the documents. I sure hope the DOJ appeals this, but it will almost inevitably go up to the Supreme Court - and who knows what will happen there. Delay, delay,delay. This judge needs to go.

DOJ seems to be 1 step behind all of the time. Heck, we don't even know what documents Trump stole. If he stole 1 foreign countries nuclear assessment, why would he steal the other 7 country's?
I'm going to watch football, go to bed and dream about a DOJ indictment, and play golf tomorrow.

This is why time is so important. We aren't even sure where DOJ is in its investigations? Early on? Mid? Preparing for an indictment?
The J6 committee got more done with less resources, less power, and less manpower.
The pyramid strategy has been a failure because it was too time consuming.

(36,631 posts)I'm not a lawyer, but I've read hundreds of court documents (during the SCO v Everybody days) and never encountered anything from a judge that was so unsupported.

True story: Was representing a guy for a bank robbery. Evidence showed that the co-defendant did the robbery without my client knowing. I asked my client on the stand what he thought when he found out the co-D robbed the bank. His answer? "That's the stupidest motherfucker in the whole world."
I did repeat that testimony gleefully to the jury. He was acquitted after a 30 minute deliberation.

(6,479 posts)adopted this theory and are using it to defend him, and the judge appears to be a fan of the theory, too. Here's a quickie summation of that theory (Wikipedia):
The Vesting Clause of Article II provides, "The executive Power [of the United States] shall be vested in a President of the United States of America." Proponents of the unitary executive theory argue that this language, along with the Take Care Clause ("The President shall take care that the laws be faithfully executed ...), creates a "hierarchical, unified executive department under the direct control of the President."[4]
The general principle that the President controls the entire executive branch was originally rather innocuous, but extreme forms of the theory have developed. Former White House Counsel John Dean explains: "In its most extreme form, unitary executive theory can mean that neither Congress nor the federal courts can tell the President what to do or how to do it, particularly regarding national security matters."[5]
Despite that drumpf is no longer president, he's asserting that taking whatever documents he wanted to take with him, whether classified or not, was within his sole discretion because he was the president at the time he took those actions.
We can only hope the 11th Circuit doesn't abide by the theory.

(8,103 posts)All around the lawyersphere, this judge is being soundly denounced as "not understanding." Well, I think she gets it. She understands that she is working for Trump.
The Gov attorneys bent over backwards to explain the matter to her, like teachers to a student. So, I guess they will file an appeal. I hope it's 50 pages long with lots of exhibits. She should have to read it.
Trump appears to be above the law. He's getting special handling. And, he is still threatening us with violence, and able to get away with it. Meantime, we are waiting for Midterms. It is clear that nothing is going to happen.

If they do not have a decision in a week, I would be concerned that they are all in Trump's pocket.
