4. I'd always heard the 5th Circuit was the worst - has been for years.

The 11th would have a long way to go to be more conservative than the 5th.

had Florida, Alabama, and Georgia split off in the early Reagan years, in forming the new 11th. Hence, I agree that the 5th has a longer history of being terrible. But the 11th is trying to catch up.

would think the 11th Cir. would have to correct her interpretation or affirm it, which would perhaps result in a denial of DOJ appeal.

Regardless of how the 11th rules, it will be appealed by one of the parties to SCOTUS.

Trump started his EP appeals re: J6 committee this time last year- it reached SCOTUS by late October, and they issued a ruling by January 2022.

In the meantime, plenty of other Trump crimes to investigate and prosecute.
